Reserving an original
Original paintings may be reserved with a deposit. The deposit amount, total purchase price, any delivery charges and the balance payment deadline will be confirmed before you pay. Your reservation is secured once we have received your deposit and confirmed acceptance of your order in writing.
Paying the balance
Your deposit forms part of the purchase price. The remaining balance, including any agreed delivery charges, must be received in cleared funds before the painting is dispatched.
Missed payments
If the balance is not paid by the agreed deadline, we will contact you and give you a reasonable opportunity to pay. If payment remains outstanding, we may cancel the reservation and offer the painting for sale again. Any refund or deduction will be handled in accordance with the cancellation terms below.
Cancellations and deposit refunds
Paying a deposit does not remove your statutory cancellation rights. For an existing original painting purchased online, by telephone or by email, you normally have the right to cancel from the time you place your order until 14 days after the day you receive the painting. An existing painting is not excluded from this right simply because it is an original or one of a kind.
If you cancel within the statutory cancellation period, your deposit and any other payments will be refunded in accordance with our Returns & Cancellation Policy and applicable law.
Where no statutory right to cancel applies, any amount retained will be limited to a fair and reasonable sum reflecting the actual loss directly caused by your cancellation, taking account of reasonable steps to reduce that loss, including resale. Any remaining payment will be refunded.
If we cannot fulfil your order
If we cancel your order because we cannot supply the painting, we will refund all payments you have made towards it.
Your statutory rights
Nothing in these terms limits your statutory rights, including your rights where goods are faulty, damaged or not as described.
